Welcome to RentInPR.com (the "Site"), operated by Palm Heaven LLC ("Company," "we," "us," or "our"). These Terms and Conditions ("Terms") constitute a legally binding agreement between you and the Company governing your access to and use of the Site and any reservation made through it.

By accessing the Site, creating a reservation, or otherwise using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must discontinue use of the Site immediately.

1. Definitions

"Company," "we," "us," or "our" refers to RentInPR.com and its operators, Palm Heaven LLC.

"You," "your," "guest," or "user" refers to any individual who accesses the Site, makes a reservation, or otherwise uses the Services.

"Property" or "Properties" refers to any vacation rental property listed on the Site.

"Reservation" refers to a confirmed booking for a Property made through the Site.

"House Rules" refers to the property-specific rules, guidelines, and restrictions applicable to a Property, as displayed in the listing description, at checkout, in booking confirmation materials, and/or in pre-arrival instructions.

"Services" refers to the Site, booking engine, payment processing, guest communications, and all related services provided by the Company.

2. Use of the Site

You agree that you will not misuse, scrape, crawl, reverse engineer, decompile, or disassemble any portion of the Site or its underlying technology; attempt to gain unauthorized access to any accounts, computer systems, or networks connected to the Site; submit false, misleading, deceptive, or fraudulent information in connection with any inquiry, reservation, or communication; interfere with or disrupt the security, integrity, availability, or performance of the Site; use the Site for any purpose that violates applicable laws, regulations, or these Terms; or use automated tools, bots, or scripts to access the Site without our prior written consent.

We reserve the right, to the extent permitted by applicable law, to refuse service, restrict access, remove content, or cancel reservations for suspected fraud, abuse, violation of these Terms, safety concerns, or any other reason at our sole discretion.

3. Listing Accuracy and Availability

We make commercially reasonable efforts to ensure that listing descriptions, photographs, amenities, pricing, and availability information are accurate and current. However, we do not warrant that all information is error-free at all times. Availability, pricing, minimum night requirements, and amenity details are subject to change without prior notice. Photographs represent typical property conditions and may vary due to updates, renovations, seasonal factors, or normal wear and use.

We reserve the right to correct errors and update listing information at any time.

4. Reservations and Eligibility

To make a reservation, you must be at least eighteen (18) years of age or the age of legal majority in your jurisdiction, whichever is greater. Certain Properties may impose additional age requirements as stated in the listing.

We may require identity verification, pre-arrival check-in completion, or other documentation prior to or following a reservation to protect guests, property owners, and the Company from fraud and unauthorized use. Failure to provide required information or complete required verification steps within the specified timeframe may result in cancellation of the Reservation.

The individual who makes the Reservation must be present during the stay and is responsible for all members of the traveling party and any visitors permitted onto the Property.

5. Payments, Fees, and Deposits

By completing a reservation, you authorize the Company and its designated third-party payment processors to charge your selected payment method for the total amount due as displayed at checkout, which may include the nightly rate for the duration of the stay; cleaning fees and other property-specific fees, if applicable; applicable taxes as required by law; and refundable security deposit or temporary authorization hold, if applicable.

If a security deposit or authorization hold is utilized, you expressly authorize the Company to place a temporary hold on your payment method and to subsequently capture or charge amounts as permitted by these Terms and the applicable House Rules for documented damages to the Property or its contents, excessive cleaning beyond standard turnover procedures, smoke remediation costs in properties with no-smoking policies, replacement of missing items or keys and associated locksmith services, fines, penalties, or costs incurred as a direct result of guest actions or violations, and costs resulting from unauthorized guests, unauthorized pets, unauthorized events, or other House Rule violations.

All charges will be supported by reasonable documentation and itemization.

6. Cancellation, Refunds, and Booking Modifications

This section is incorporated into these Terms and applies to every Reservation made through the Site.

A. Applicable Policy. The cancellation and refund policy displayed at the time of checkout and included in your booking confirmation documentation shall govern your Reservation. Because Properties, seasons, and stay lengths vary, cancellation and refund terms may differ by Property, date range, or duration of stay. By completing a Reservation, you acknowledge and agree to the specific cancellation and refund policy presented at checkout and in your confirmation.

B. Refund Terms. If your Reservation qualifies for a refund under the applicable cancellation policy, the refund will be issued to the original payment method used at the time of booking. If the Reservation is partially refundable, the refundable portion will be calculated in strict accordance with the applicable policy. If the Reservation is designated as non-refundable, no refund will be provided except where required by applicable law. Refund processing times are subject to the policies and procedures of your financial institution or payment processor and may require several business days following approval.

C. Date Changes, Extensions, and Modifications. Any request to modify Reservation dates, extend the stay, or change the number of guests is subject to availability and may result in changes to the total price, applicable minimum night requirements, cancellation and refund terms, and taxes and fees. The Company is not obligated to approve modification requests.

D. No-Shows and Early Departures. Failure to check in on the scheduled check-in date (no-show) and voluntary early departure prior to the scheduled check-out date are generally non-refundable unless the applicable cancellation policy explicitly provides otherwise or applicable law requires a refund.

E. Force Majeure and Travel Disruptions. Puerto Rico is a tropical destination, and weather events, natural disasters, and other disruptions may occur. The Company shall not be liable for, and is not responsible for, disruptions caused by events beyond its reasonable control, including but not limited to hurricanes, tropical storms, flooding, earthquakes, power outages, water service interruptions, airline cancellations, road closures, government-mandated orders, public health emergencies, acts of terrorism, or similar force majeure events. Any refund eligibility in force majeure situations shall be determined by the cancellation policy applicable to your Reservation, except where applicable law requires otherwise.

F. Duty to Report Issues During Stay. If you experience any problem, deficiency, or concern during your stay, you must notify the Company promptly by contacting us at [email protected] or +1 (321) 321-2348 and provide the Company a reasonable opportunity to investigate, troubleshoot, and remedy the issue. Refund or compensation requests may be denied if the issue was not reported promptly during the stay; a reasonable remedy was offered by the Company and declined by the guest; or the issue was caused by guest misuse, negligence, or violation of House Rules.

G. Fraud and Policy Abuse. The Company reserves the right, to the extent permitted by applicable law, to deny refund requests, cancel Reservations, or restrict access to Services where the Company reasonably believes there is fraudulent activity, chargeback abuse, filing of false or exaggerated claims, or material violation of House Rules or these Terms.

7. Guest Responsibilities

During your stay, you agree to comply with all applicable House Rules, local laws, ordinances, and regulations; treat the Property with reasonable care and maintain it in good condition; respect neighbors, observe quiet hours, and minimize disturbances; not exceed the maximum occupancy stated in the listing; not host parties, gatherings, or events unless explicitly approved in writing by the Company; comply with all no-smoking policies, where applicable; comply with all pet policies, where applicable; keep the Property secured and locked when unoccupied; report any damages, maintenance issues, safety concerns, or emergencies to the Company promptly; and ensure that all members of your traveling party and any visitors you permit onto the Property comply with House Rules and these Terms.

You are personally responsible and liable for the actions, conduct, and any resulting damages caused by all members of your traveling party and any visitors you allow onto the Property.

8. Damages, Excessive Cleaning, and Charge Authorization

You expressly authorize the Company to charge your payment method on file for documented costs arising from your stay, including but not limited to repair or replacement costs for damaged Property, furnishings, fixtures, appliances, or other items; excessive cleaning costs that exceed standard turnover cleaning procedures; smoke remediation and deodorization costs in Properties with no-smoking policies; replacement of missing items, keys, or access devices, and associated locksmith or rekeying services; fines, penalties, or assessments imposed by building management, homeowner associations, or governmental authorities as a direct result of guest conduct; and costs resulting from unauthorized guests, unauthorized pets, unauthorized events or parties, or other violations of House Rules.

The Company will provide reasonable documentation and itemization of any charges assessed under this section.

9. Maintenance, Repairs, and Amenity Interruptions

Properties may require periodic maintenance or repairs during or between guest stays. The Company will make commercially reasonable efforts to address reported maintenance issues in a timely manner.

The Company does not guarantee uninterrupted availability or functionality of amenities or services including, but not limited to, wireless internet (WiFi), cable television, electricity, water supply, air conditioning, heating, pool systems, hot tubs, elevators, or appliances. Where an outage or malfunction materially affects the habitability of the Property, any remedy, accommodation, or compensation shall be at the sole discretion of the Company unless otherwise required by applicable law, and will be evaluated based on the timing, cause, severity, and duration of the disruption and the Company's ability to effect a repair or provide an alternative.

10. Safety and Assumption of Risk

You acknowledge that travel, short-term vacation rentals, and use of recreational amenities involve inherent risks, including but not limited to risks associated with stairs, balconies, elevated surfaces, swimming pools, hot tubs, beach conditions, ocean currents, weather conditions, wildlife, and local environmental conditions.

You assume full responsibility for evaluating and managing risks for yourself and all members of your traveling party, and for using the Property and its amenities in a safe and responsible manner. The Company recommends that guests with young children, elderly family members, or individuals with mobility limitations carefully review Property descriptions and contact us with any questions regarding accessibility or safety features prior to booking.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

The Site and Services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

The Company, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of the Site, Services, or any Reservation.

The Company shall not be liable for loss of, theft of, or damage to personal belongings, luggage, vehicles, or valuables during your stay.

The Company shall not be liable for events, circumstances, or conditions beyond its reasonable control, including force majeure events as described in Section 6(E).

The Company's total aggregate liability for any and all claims arising out of or related to a single Reservation shall not exceed the total amounts actually paid by you to the Company for that specific Reservation.

CERTAIN JURISDICTIONS DO NOT PERMIT THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY. IN SUCH JURISDICTIONS, THE COMPANY'S LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY APPLICABLE LAW.

12. Indemnification

You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, demands, actions, damages, losses, liabilities, judgments, settlements, costs, and expenses (including reasonable attorneys' fees and legal costs) arising out of or related to your access to or use of the Site or Services; your Reservation, stay, or conduct at any Property; any violation of House Rules or these Terms by you or members of your traveling party; any negligent, reckless, or willful misconduct by you or members of your traveling party; any unauthorized, illegal, or fraudulent activity by you or members of your traveling party; or any claim by a third party arising from your actions or omissions in connection with the Site, Services, or any Property.

13. Disputes, Chargebacks, and Payment Disputes

Prior to initiating any chargeback, payment dispute, or reversal with your financial institution or payment processor, you agree to first contact the Company at [email protected] and provide the Company a reasonable opportunity (not less than ten (10) business days) to investigate, review, and attempt to resolve the matter directly.

To the extent permitted by applicable law, the Company reserves the right to pursue recovery of amounts owed, restrict or terminate account access, and take appropriate collection actions in cases of abusive chargebacks, fraudulent disputes, or bad faith claims.

14. Intellectual Property

All content, materials, text, images, graphics, logos, trademarks, trade dress, software, and other intellectual property displayed on or available through the Site are the property of the Company or its licensors and are protected by applicable copyright, trademark, and other intellectual property laws.

You may not reproduce, copy, distribute, modify, create derivative works from, publicly display, or otherwise exploit any Site content without the prior written consent of the Company.

15. Third-Party Services

The Site may utilize or integrate with third-party services for purposes including, but not limited to, booking engine technology, payment processing, identity verification, fraud prevention, analytics, marketing, messaging, and customer support. Your use of such third-party services may be subject to their respective terms of service and privacy policies, which are independent of and supplementary to these Terms.

16. Termination and Refusal of Service

The Company reserves the right, to the extent permitted by applicable law, to refuse service, restrict or terminate access to the Site, and cancel Reservations at its sole discretion for fraud prevention, safety concerns, violations of House Rules or these Terms, failure to complete required verification, abusive or threatening behavior toward Company staff, or any other reason the Company deems appropriate.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy, applicable House Rules, and the cancellation policy presented at checkout, constitute the entire agreement between you and the Company regarding your use of the Site and Services, and supersede all prior or contemporaneous agreements, representations, and understandings, whether written or oral.

19. Waiver

The failure of the Company to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of the Company.

20. Governing Law and Venue

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Puerto Rico, without regard to its conflict of law principles. Any legal action, suit, or proceeding arising out of or related to these Terms shall be brought exclusively in the courts of competent jurisdiction located in the Commonwealth of Puerto Rico, and you hereby consent to the personal jurisdiction and venue of such courts, except where a different venue is mandated by applicable law.

21. Changes to These Terms

The Company reserves the right to modify, amend, or update these Terms at any time. Any changes will be reflected by updating the "Last Updated" date at the top of this document. Your continued use of the Site following the posting of revised Terms constitutes your acceptance of such changes. We encourage you to review these Terms periodically.
